1) Acceptance & Scope

These Fan Terms govern your use of the WildTwin.ai website and services as a Fan (the Platform). By creating an account, making a purchase, subscribing, or otherwise using the Platform, you agree to these Fan Terms and our Privacy Notice, Cookie Notice, Content & Safety Policy, and other policies referenced here (together, the Policies). If you do not agree, do not use the Platform.

2) Key Definitions

• Creator: A person who uploads training data and/or publishes AI-generated content that you may view after purchase or subscription.
• AI Content: Images, videos, text, audio, or other media created with our AI tools or hosted on the Platform for a Creator.
• Subscription: A recurring, auto-renewing purchase that grants you access to a Creator's gated content for a period (e.g., one month), subject to these Terms.
• Premium/PPV Content: One-off purchases outside your Subscription (if offered).
• Fan License: The limited, personal license to view AI Content on the Platform, described in §8.

3) Eligibility, Account & Security

1. Age / Majority: You must be 18+ and the age of majority where you live. Strictly no minors.
2. Account: Provide accurate information. You're responsible for all activity under your account and for maintaining the confidentiality of login credentials. Use strong passwords and 2FA where available.
3. Verification: We may require verification (e.g., email, phone, 3-D Secure, or other checks) to prevent fraud and to comply with law.
4. Sanctions & Region Blocks: You may not use the Platform if you are on sanctions lists or in restricted regions. We may geoblock content to comply with law.

4) Purchases, Prices, Taxes & Billing

1. Prices: Prices are set by Creators within ranges we allow. Prices may vary by region and currency and may include applicable taxes where required by law. If VAT or sales tax applies, it will be shown at checkout or on your receipt.
2. Auto-Renewals: Subscriptions auto-renew for the same period unless you cancel before the renewal time shown at checkout and in your account settings. By subscribing, you authorize us (and our payment processors) to charge the then-current price plus taxes each renewal cycle.
3. Trials & Promotions: If offered, trials convert to paid auto-renewals unless you cancel before the trial ends. We may change or end promotions at any time.
4. Payment Processing: Payments are processed by third-party processors. Your statement descriptor and available payment methods may vary by country and card network. We are not responsible for fees charged by your bank or card issuer.

5) Right of Withdrawal for EU/EEA Consumers (Digital Content)

1. Immediate Supply: Many purchases provide immediate access to digital content not supplied on a tangible medium. By completing the purchase, you expressly request immediate performance and acknowledge you will lose the 14-day right of withdrawal once delivery begins.
2. Where Withdrawal Still Applies: If a purchase has not been delivered and access has not begun, you may have a statutory right to withdraw within 14 days. Use the contact details above to exercise it.

6) Cancellations, Refunds, Credits & Chargebacks

1. Cancellations: You can cancel a Subscription at any time in your account. Cancellation stops future renewals; it does not retroactively refund the current period.
2. Refunds (General): Except where required by law or these Terms, all completed digital purchases are non-refundable once delivered.
3. Billing Errors & Unauthorized Charges: We will correct obvious billing errors and refund unauthorized charges once verified.
4. Content Removed by Creators: If, within a calendar month, a Creator removes more than 50% of their eligible subscription library (and had at least 10 posts at the start of that month), we may issue account credits or refunds for that month and cancel/refund pre-paid future months for impacted Fans, at our reasonable discretion.
5. Takedowns for Safety/Legal: If content is removed to comply with law, valid rights/privacy claims, or our safety policy, we handle remedies case-by-case. We may issue credits or refunds where appropriate.
6. Chargebacks: If you file a chargeback, your access may be paused during review. Repeated, unfounded chargebacks may lead to account limits or termination.

7) Fan Conduct — What's Not Allowed

To keep the Platform safe:

• No minors: Never upload, request, or discuss sexual content involving minors (real, simulated, or "young-looking").
• No illegal or exploitative content: Including non-consensual acts, bestiality, trafficking, sexual violence, doxxing, or threats.
• No harassment or hate: Don't bully, harass, or target anyone on protected grounds.
• No real-world sexual services: The Platform is for online digital content only. No escorting or solicitation.
• No spam, scams, or fraud: Don't attempt to defraud Creators, other Fans, or us.
• No circumvention: Don't attempt to bypass paywalls, copy protection, or access controls.
• No scraping/automation: Don't harvest data, scrape, or use bots without written permission.
• No impersonation: Don't pretend to be someone else, including Creators or staff.

Violations may lead to content removal, feature limits, suspension, or termination.

8) Your License to View Content (Personal Use Only)

1. License: When you purchase or subscribe, you receive a limited, revocable, non-exclusive, non-transferable license to view the relevant Creator's content on the Platform for your personal, non-commercial use during the paid period.
2. No Downloads or Redistribution: You may not copy, download, save, record, livestream, repost, sell, or distribute any content, nor remove or alter watermarks, DRM, or metadata.
3. Termination of License: Your license ends when your paid access ends, when content is deleted, or if your account is terminated.

9) AI Content Disclosures

1. Labeling & Watermarks: AI media is labeled and/or watermarked. Do not remove or obscure these markings.
2. Realism & Limits: AI may produce realistic but fictional outputs. You should not rely on AI Content as factual depictions of real events or people's real-world conduct.
3. Third-Party Rights: You must not prompt for or encourage content that would violate others' rights (e.g., real-person deepfakes, celebrities, or copyrighted characters).

10) Reporting & Notice-and-Action

1. Report Tools: Use in-product tools to report illegal or policy-violating content. We prioritize urgent safety reports.
2. Rights/Privacy/Defamation Notices: Rights holders and impacted persons can send detailed notices. We may remove or restrict content while we investigate and notify the Creator for a response.

11) Data Protection (GDPR) & Privacy

1. Controller: For Fan account data, we are the data controller. See our Privacy Notice for details of processing.
2. Legal Bases: Contract performance (providing your purchases), legitimate interests (security, fraud prevention, product improvement), and compliance with legal obligations.
3. Transfers: We may transfer data outside the EEA using approved safeguards (e.g., SCCs).
4. Your Rights: Access, correction, deletion, objection, restriction, portability. Submit requests via your account or contact us. We will verify your identity before acting.
5. Security: We use appropriate technical and organizational measures. You must also secure your account.

12) Service Availability & Changes

We aim for high availability but do not guarantee uninterrupted service. Features may change, be added, or removed. We may suspend access for maintenance, security, or legal reasons.

13) Termination

We may suspend or terminate your account (with or without notice) for violations of these Terms, illegal activity, fraud/chargeback risk, or as required by law. You may close your account at any time. On termination, your remaining licenses to view content end.

14) Intellectual Property

All Platform software, designs, and content (other than what belongs to Creators) are owned by us and our licensors. All rights reserved. Any unauthorized use of the Platform or content is prohibited.

15) Disclaimers & Limitation of Liability

1. AS IS: The Platform and AI features are provided "as is" and "as available."
2. No Warranties: To the maximum extent permitted by law, we disclaim all warranties (express or implied), including fitness for a particular purpose and non-infringement.
3. Limits: To the maximum extent permitted by law, we are not liable for: (i) indirect, incidental, special, or consequential damages; (ii) loss of data, revenue, or goodwill; or (iii) amounts exceeding the total fees you paid to us in the 6 months before the claim.
4. Nothing in these Terms excludes liability where it cannot be excluded by law (e.g., for fraud).

16) Changes to These Terms

We may update these Terms. Material changes will be posted on the Platform or emailed at least 30 days in advance unless required sooner by law or safety. Continued use after the effective date means acceptance.

17) Governing Law & Disputes

These Terms are governed by Luxembourg law. Unless mandatory consumer protections require otherwise, the courts of Luxembourg City have exclusive jurisdiction. We encourage amicable resolution or mediation before litigation.

18) Miscellaneous

Severability; no waiver; assignment (you may not assign without our consent; we may assign with notice); force majeure; interpretation contra proferentem waived; headings for convenience only; entire agreement (these Terms plus the Policies).

1) Acceptance & Scope

These Creator Terms govern your participation as a Creator on WildTwin.ai (the Platform). By creating a Creator account or uploading training data or content, you accept these Terms, our Privacy Notice, Cookie Notice, and Content & Safety Policy. If you do not agree, do not use the Platform.

2) Key Definitions

• AI Content: Images, videos, text or other media created with our AI tools using your Training Data.
• Authorized Likeness: Your face, body, name, voice and persona that you authorize us to process.
• Fan: A user who follows, subscribes to, or purchases content from you.
• Gross Revenue: All amounts paid by Fans for your subscriptions, premium content, tips, before deductions.
• Platform Fee: Our service fee taken from Gross Revenue (currently 20%).
• Payout: Your earnings after deducting fees, taxes, refunds/chargebacks, and reserves.
• Training Data: Photos, videos, audio, text that depict your Authorized Likeness and that you upload to build or improve your model.

3) Eligibility, Verification & Safety

1. Age / Majority: You must be 18+ and the age of majority where you live. Strictly no minors.
2. Identity & Age Verification: You must complete KYC, including a valid government ID, selfie/liveness checks, and proof of address. If you fail or refuse KYC, your account may be suspended or closed.
3. Recordkeeping: You agree to keep accurate age/identity records for any collaborators you feature.
4. Account Security: Use strong passwords and 2FA. You're responsible for all actions under your account.
5. Independent Contractor: You act as an independent contractor, not our employee. You handle your own taxes and social charges.

4) Likeness, Training Data & AI Models

1. Your Rights: You retain rights you hold in your Authorized Likeness and Training Data. You confirm you have the right to authorize our processing of both.
2. Explicit Consent: You give explicit consent for us and our subprocessors to process your personal data (including facial/biometric features) to create and operate your model and the Platform.
3. License to Operate: You grant us a license to host, store, process, watermark, distribute, and use your Training Data and AI Content to provide and improve the Platform.
4. Model Ownership: All Platform software, algorithms, weights, LoRAs, and models are owned by us. We grant you a license to use your model only on the Platform.
5. Outputs & IP Status: You own whatever rights you may have in AI Content in your country. We do not guarantee that AI Content is protectable in any jurisdiction.
6. Deletion & Withdrawal: You can delete Training Data at any time. On request, we will retire your model within a reasonable period.
7. No Other Likenesses: Upload only your own Authorized Likeness. Strictly no third-party likenesses, fictional characters, or copyrighted works you don't own.

5) Content & Safety Rules

Absolutely Prohibited:

Depictions or suggestions involving minors (real or simulated), incest, non-consent, bestiality, hate/terror/violence, sexual exploitation, self-harm, trafficking, doxxing, or illegal activity.

Sensitive / Restricted:

Content with realistic weapons, bodily fluids, extreme fetishes, or that could be unlawful in certain regions. We may require region blocks or reject such content.

Watermarking: All AI media is watermarked. Do not remove or obscure watermarks.

Moderation: We may remove or restrict content, apply geoblocks, suspend features, or terminate accounts for Policy violations.

6) Your Promises

You represent and warrant that: (a) all account info is accurate; (b) you are 18+ and sole owner of your Authorized Likeness and Training Data; (c) your uploads and AI Content comply with laws and these Terms; (d) you will not encourage off-platform payments, spam, or scams; (e) you will promptly cooperate with safety, fraud and chargeback reviews.

7) Pricing, Licenses to Fans, and Takedowns

1. Your Pricing: You set subscription and pay-per-view prices within ranges shown in your Dashboard.
2. Platform Discovery: You allow us to show thumbnails/clips of your AI Content on the Platform to promote your profile.
3. Takedowns by You: You may delete or take down posts at any time. If you delete more than 50% of your eligible library in a calendar month (and had at least 10 posts at month start), we may issue account credits or refunds to impacted subscribers.
4. Takedowns by Us: We can remove content or suspend accounts for violations, illegal content, fraud risk, or repeated chargebacks.
5. Fan License: When you post, you grant each paying Fan a limited license to view your content on the Platform for personal use.

8) Payments, Fees, Taxes & Chargebacks

1. Platform Fee: Currently 20% of Gross Revenue. We'll give at least 30 days' notice before changes.
2. Processor Fees: Payment processors will deduct their fees.
3. Payouts: Shown in your Dashboard (frequency, thresholds, available payout methods).
4. Taxes: You are responsible for your taxes. Where law requires, we may collect/remit taxes and adjust your Gross Revenue accordingly.
5. Refunds & Chargebacks: We may issue refunds under our Fan policy. You are responsible for chargebacks. We may hold a rolling reserve and offset negative balances.

9) Data Protection (GDPR)

For your Training Data we act as a controller operating your requested service. You have rights to access, rectification, deletion, portability, restriction, and objection. We may transfer data outside the EEA using approved safeguards.

10) Deactivation & Termination

Your Deactivation: You can deactivate at any time. Choose either: (A) Run-out: Stop new subscriptions; keep content accessible to current subscribers until their term ends; or (B) Refund: Immediate removal with pro-rated refunds to active subscribers.

Termination by Us: We may suspend or terminate immediately for serious violations, fraud/chargeback risk, illegal content, or failure of KYC.

11) Disclaimers & Liability

1. AS IS: The Platform and AI features are provided as is and as available.
2. No Warranty: We disclaim all warranties to the extent permitted by law.
3. Limitation: Our aggregate liability to you will not exceed the Platform Fees we retained from your earnings in the 6 months before the claim.
4. Indemnity: You will defend and indemnify us against claims arising from your uploads, AI Content, conduct, or breach of these Terms.

12) Governing Law & Disputes

These Terms are governed by Luxembourg law. Courts of Luxembourg City have exclusive jurisdiction, unless mandatory consumer/worker protections say otherwise. Mediation is encouraged before litigation.
